Terms of Delivery

THE HOUSE OF RARE WHISKY

1. THE HOUSE OF RARE WHISKY and thehouseofrarewhisky.com (hereinafter referred to as "THORW", “we”) is established in Andijk, the Netherlands.

2. These terms of delivery are applicable to all orders from and agreements with THORW. Deviating from said terms of delivery is only possible when agreed upon in writing with THORW.

3. It is against the law to sell or supply alcohol to anyone under 18 years of age in the Netherlands. By placing an order you confirm that you are at least 18 years old. You (the “recipient” or the “customer”) may order wines, spirits, other goods or other services (each individually and collectively referred to as "goods" or " whisky") the various methods mentioned below (unless stated otherwise).

4. No rights can be derived from the prices presented on the website of THORW. THORW reserves the right to retract and change said prices at all times. All offers are dependent on availability.

5. THORW is not liable for damages due to inaccuracies, technical malfunctions and/or other problems caused by the Internet.

6. The prices of the products are denoted in Euros and are clearly presented on the website. These prices include VAT (where applicable) as well as alcohol taxes, yet are excluding shipping costs and custom dues.

A surcharge of 3.5% will be applied to customers outside the European Union for payments via credit card or PayPal.

The prices of the products from the *private collection* - as indicated under 'Info / Variant' on our website - include VAT as well as alcohol taxes, but these cannot be deducted.

7. The standard shipping costs are based on the costs for the shipment of two (2) bottles. In case the order consists of more than two (2) bottles, additional shipping costs will be charged.

8. THORW will do its best to secure delivery within 14 days of the date of your order, but shall not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control. Neither THORW nor its carrier will be liable for non-receipt of the goods. We will deliver to the address as you have entered it on the order. We cannot accept any liability for late or failed delivery if the quoted address is incorrect or incomplete. Please check the delivery address if you are uncertain. If you request a delivery to a business, we shall consider the delivery to be successful, if it is delivered to a reception area and signed for by a representative at that address.

Delivery can take up to 14 days from the date we receive your order, although every effort will be made to despatch earlier. All parcels are sent by an insured carrier and must be signed for. Do not accept damaged goods. If goods fail to arrive after 14 days, please notify us by email via info@ thehouseofrarewhisky.com

We require someone of legal age under local licensing laws to be present at the delivery address to sign for acceptance of the goods. Goods are despatched by a third party courier and their terms and conditions apply.

9. THORW will accept the return of goods, and issue a full refund, when:

  1. the goods have demonstrably been damaged prior to transit; or
  2. the goods received are clearly different from those ordered; and
  3. the recipient has notified us of the fact within 24 hours of receipt.

Goods shall not be returned unless and until the customer or the recipient has:

  1. advised THORW (info@ thehouseofrarewhisky.com); and
  2. THORW has accepted the return of the goods, in which case only, THORW shall be responsible for the cost of transit by the method specified by us. Refunds will be credited back to your account upon our receipt of the goods.

10. Under Distance Selling legislation, customers have a 14 day cooling-off cancellation period which is 14 days from the day the goods are received. This does not apply to items that are bespoke or personalised.

In the event of cancellation, the cost of returning the goods will be the responsibility of the customer and not THORW and the goods must be returned within 14 calendar days of the date of cancellation. Refund will be made on receipt of the goods.

11. The invoice has to be paid by the customer according to the chosen method of pay during the ordering procedure on the website.

12. When an order is placed on the website the customer will receive an order confirmation on the e-mail address provided by said recipient.

13. Shipments can be made in the Netherlands and all other countries for which no restrictions exist regarding the import of alcoholic products.

14. When the agreed upon delivery time cannot be met, THORW shall notify the customer by e-mail.

15. We strongly recommend that our customers speak to their local Customs & Excise Office regarding the shipping of whisky, as it is the responsibility of the customer to check if and what customs restrictions apply and to notify THORW of any special instructions. THORW cannot be held liable for any customs duties and taxes.

THORW, where appropriate, will complete a customs declaration form declaring 'Specialist Malt Whisky, No Commercial Value' and stating replacement value. Prices shown are inclusive of VAT, which may be deducted for non-EU countries. However, customers may be liable for taxes/duties in their own countries.

16. Whisky is sent entirely at the customers own risk as we are unable to guarantee safe delivery (e.g. check of the contents by local Customs & Excise Office).

17. In the United States of America, we cannot deliver to New Hampshire, Alabama, Arizona, Kentucky, Massachusetts, Mississippi, North Dakota, Pennsylvania or Utah. We can only deliver to major cities in Alaska. PO boxes are not acceptable for delivery purposes. Military bases are very difficult to deliver to and must as a minimum have a physical address attached to them. Schools are not acceptable addresses due to the nature of the contents of the packages.

18. THORW is not liable for breaching any obligations when it is unable to do so due to circumstances beyond THORW’s control. These circumstances can refer to technical failures within the company, disruption in the Internet connection, delays in shipment, strikes and delays caused by suppliers, among others.

19. If the recipient has a complaint, said complaint must be sent by e-mail. THORW will try and resolve the complaint as soon as possible and inform the recipient by e-mail of the action undertaken.

20. All information provided by the customer and/or the recipient is stored in a file. This information is solely used for the proper delivery of the order to said customer or recipient.

21. The intellectual property rights of the website www.thehouseofrarewhisky.com including the software language, search methods, texts and images belong to THORW.

22. The Dutch law is applicable to all orders and agreements of THORW.

23. The customer and the recipient agree to terms of delivery when an order is placed. All correspondence regarding the terms of delivery is by e-mail via info@ thehouseofrarewhisky.com .
